KSRTC to pay compensation to Employee as Directed by HC
Kerala State Road Transport Corporation (KSRTC) have been directed by Kerala high court yo pay the litigation cost of `25,000 to an empanelled driver, who was dragged to the Court on an issue related to regularisation of employment.
Justice C K Abdul Rahim passed the order on a contempt petition filed by C Mohanan, who was working as an empanelled driver on provisional/daily basis at Thotthappally, Kozhikode.
The Court had earlier directed the KSRTC to consider the request of the petitioner for regularisation. However, the KSRTC rejected the request, saying that he was having only 8 years’ of service, with 120 duties per year. The petitioner did not have 120 duties on every year in all the 10 years.
The Court observed that the government would look into the situation, which has led to payment of compensation to the petitioner. If the government is convinced that the incumbent at office of the KSRTC was responsible for the loss incurred to the Corporation, which is fully owned by the government, a decision should be taken to recover the amount from the salary of the incumbent responsible.
The counsel for the KSRTC submitted that the order rejecting the petitioner’s claim would be withdrawn and appropriate steps would be taken to regularise the petitioner.
