Ship to be Arrest and being detained in South Africa

The Kerala High Court on Tuesday ordered arrest of the ship m.v. BMC Genisis currently anchored at the West African territorial waters. The vessel is now berthed at the port of Teema in Ghana. The petitioner has been rendering ship management services to the vessel and on account of an outstanding amount of Rs 60 lakh, the company has raised a maritime claim and obtained the arrest order.
The High Court directed the Director of Ports, Port of Teema, to arrest and detain the vessel under safe-custody till the owners of the vessel furnish a security for Rs 60 lakh before the Registrar of the Kerala High Court.
This is the first time that an Indian High Court exercises its inherent Admiralty Jurisdiction to arrest a vessel, which is outside the territorial waters of India, he said.
